In a recent development, allegations of discharge certificate forgery against Enugu State Governor, Barrister Peter Ndubuisi Mbah, brought by the National Youth Service Corps (NYSC), have been dismissed by a Federal High Court in Abuja. Justice Inyang Eden Ekwo ruled that the NYSC failed to provide sufficient evidence to support their allegations.
The judge imposed a fine of N5 million on the NYSC to be paid to the governor, citing that the Corps suppressed facts and conspired against him. The court found that Mbah’s unchallenged evidence of receiving his discharge certificate in 2003, after serving in a law firm in Lagos, was compelling and that the NYSC failed to present counter-evidence.
Justice Ekwo emphasized that the burden of proving forgery allegations rested on the NYSC, and their inability to do so made Mbah’s evidence more credible. The lawsuit was filed by Mbah against the NYSC and its Director, Corps Certification, Ibrahim Muhammad, in response to a disclaimer published by the NYSC, denying the issuance of a discharge certificate to him on January 6, 2003.
